Judicial oligarchy fabricating a brand new Constitution

It is critically important that we have good judges, and that is the most important issue for conservatives at the federal level at this point. An example of how important pro-life judges are can be seen in a rather hysterical article at Slate. A Texas law that strictly regulated abortion “clinics” was struck down, and now a similar Louisiana law is under attack.

The thing that stuck out in the article was this line:

“An abortion restriction runs afoul of the Constitution if its burdens on women outweigh its benefits.”

This is a standard wholly fabricated by the judiciary with no basis in the law or the Constitution. Worse yet, it is a completely subjective standard. Do we really believe that the courts are qualified to assess the medical and health benefits of mandating that doctors who perform abortions have admitting privileges at a nearby hospital? Judges are not omni-competent in all fields.

Some pro-life advocates are saying that we need more from Republicans than to toss a few pro-life judges our way, and that we need actual concrete action. This is a good point, and there is simply no excuse for Republicans to not completely de-fund Planned Parenthood when they controlled the White House and both houses of Congress in 2017 and 2018. But the battle over abortion rights is largely taking place in the states, with the federal courts repeatedly striking down efforts to save lives.

It would be nice to have a pro-life Congress actually do more, but the primary obstacle to saving lives right now is an activist federal judiciary. That obstructionist mentality needs to be broken.
